The 5 Things You Must Do After a Car Accident

1 Get yourself and your vehicle out of danger

If you’re not injured and the accident was minor, carefully drive your car to the side of the road so it doesn’t impede traffic. Keep your hazard lights on and set up flares or reflective emergency triangles to alert other drivers to slow down. However, if the crash is more severe or if anyone is hurt, leave the vehicles where they are. Even if you don’t think you’ve been injured, be extra careful when getting out of your car, especially if the accident took place on a highway or busy street. You may not be thinking logically, which could put you in danger.

2 Contact Police

If the police arrive, note the officer’s name, badge number, and contact information. Be sure to get a copy of the accident report from the officer. If the police do not come, you can request a copy of the report from the local police office, or through the insurance adjuster handling your claim.

3 Collect important information

Use your phone camera to take pictures of documents or, with pen and paper, get the name, address, phone number, and driver’s license number of everyone involved in the accident. If the driver’s name doesn’t match up with the car’s registration or insurance papers, determine the person’s relationship to the vehicle’s owner.

Then, gather all vehicle information including year, make and model, color, license plate number, and vehicle identification number. Get the insurance policy number and the company’s phone number, in case the other person doesn’t report the accident. See if any witnesses are willing to provide you with contact information and details about what they saw.

Record the date and time of the accident, and photograph or video the entire scene of the accident, including skid marks or property damage. Note street names and the direction each vehicle was heading both before and after the accident. One thing that often gets missed is the position of the cars [relative] to the street. This is critical information because it helps the adjuster re-create the accident when you report the claim.

Never share your Social Security number, the coverage limits on your insurance policy, or other personal information.

4 Avoid roadside discussions about responsibility

Never discuss the responsibility or events with the other parties.

5 Contact experienced professionals – Insurance Agent, Doctor, Attorney

Contact an experienced attorney to discuss any potential issues. If you were injured, schedule a doctor visit/follow-up right away. Make sure you report your accident per your insurance policy expectations. Depending upon your circumstances, it may be beneficial to discuss your situation and the specifics with a qualified personal injury attorney prior to documenting the accident with your insurance agent/company.

Settlements & Verdicts

Below are summaries of settlements and verdicts that have been won by Mark Godbey and Godbey Law LLC for our clients. Contact us for a free consultation today.

$375,000– Our client, a 65-year old gentleman, was driving his 1964 Ford tractor on a rural road in Warsaw, Kentucky.  A 15-year old girl who did not have a license, was driving her boyfriend’s car, went left of center, and hit our client head-on.  Our client survived for 42 days before passing away. We were able to piece together insurance policies from the car’s owner, the driver’s parents, and a farm insurance policy to recover this amount for our client’s surviving spouse and children. We were also successful in getting the health insurance company to waive all of their subrogation claims.

$1,200,000 Our client, a 17-year old male, was a back seat passenger in a Volkswagen Jetta. The driver of the Jetta lost control, went off the side of the highway and flipped over several times. Our client was thrown from the vehicle and sustained numerous internal injuries, including head trauma, which required cranial decompression surgery.

$287,500 We recovered this amount for our client, a 58-year old male, who was driving his dump truck for his company. Another truck pulled out from a stop sign, causing a severe crash and resulting in several injuries to our client, including a torn rotator cuff in the right shoulder and a cut on his left ear.
